temel nitelikleri, sat\u0131\u015f fiyat\u0131 ve \u00f6deme \u015fekline ili\u015fkin \u00f6n bilgileri okuyup, bilgi sahibi oldu\u011funu, elektronik ortamda gerekli teyidi verdi\u011fini kabul, beyan ve taahh\u00fct eder.<span class=\"Apple-converted-space\">\u00a0<\/span><\/li><li>SATICI \u00fcr\u00fcnleri m\u00fccbir sebepler haricinde 30 (otuz) g\u00fcnl\u00fck yasal s\u00fcreyi a\u015fmamak kayd\u0131yla ALICI\u2019ya teslim etmeyi kabul, beyan ve taahh\u00fct eder.<span class=\"Apple-converted-space\">\u00a0<\/span><\/li><li>SATICI, s\u00f6zle\u015fme konusu hizmeti eksiksiz ve s\u00f6zle\u015fmede belirtilen niteliklere uygun vermeyi, her t\u00fcrl\u00fc ay\u0131ptan ar\u00ee olarak yasal mevzuat gereklerine ve standartlara uygun bir \u015fekilde i\u015fin gere\u011fi olan bilgi ve belgeler ile i\u015fi do\u011fruluk ve d\u00fcr\u00fcstl\u00fck esaslar\u0131 dahilinde ifa etmeyi, hizmet kalitesini koruyup y\u00fckseltmeyi, i\u015fin ifas\u0131 nedenle s\u00f6zle\u015fme konusu bedelin \u00f6denmemesi ve\/veya banka kay\u0131tlar\u0131nda iptal edilmesi halinde, SATICI\u2019n\u0131n s\u00f6zle\u015fme konusu \u00fcr\u00fcnleri teslim etme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn sona erece\u011fini kabul, beyan ve taahh\u00fct eder.<\/li><li>SATICI, taraflar\u0131n iradesi d\u0131\u015f\u0131nda geli\u015fen, \u00f6nceden \u00f6ng\u00f6r\u00fclemeyen ve taraflar\u0131n bor\u00e7lar\u0131n\u0131 yerine getirmesini engelleyici ve\/veya geciktirici hava muhalefetleri, ula\u015f\u0131m\u0131n kesilmesi, yang\u0131n, deprem, sel bask\u0131n\u0131 gibi m\u00fccbir sebepler nedeniyle s\u00f6zle\u015fme konusu mal\u0131 ifa edemez ise, durumu ALICI\u2019ya bildirece\u011fini kabul, beyan ve taahh\u00fct eder.<span class=\"Apple-converted-space\">\u00a0<\/span><\/li><li>ALICI veya ALICI taraf\u0131ndan belirlenen \u00fc\u00e7\u00fcnc\u00fc ki\u015finin teslim an\u0131nda adreste bulunmamas\u0131 durumunda ALICI\u2019n\u0131n \u00dcr\u00fcn\u2019\u00fc ge\u00e7 teslim almas\u0131ndan ve\/veya hi\u00e7 teslim almamas\u0131ndan kaynaklanan zararlardan ve giderlerden SATICI sorumlu de\u011fildir.<\/li><li>ALICI, \u00fcr\u00fcn\u00fc teslim ald\u0131\u011f\u0131 anda kontrol etmek ve g\u00f6rd\u00fc\u011f\u00fc ay\u0131plar\u0131 derhal SATICI\u2019ya bildirmekle SATICI, Platform\u2019da teslimat \u00fccretinin kendisince kar\u015f\u0131lanaca\u011f\u0131n\u0131 beyan etmi\u015fse teslimat masraflar\u0131 SATICI\u2019ya ait olacakt\u0131r.<\/li><li>\u00dcr\u00fcn ediminin yerine getirilmesinin imkans\u0131zla\u015ft\u0131\u011f\u0131 hallerde SATICI\u2019n\u0131n bu durumu \u00f6\u011frendi\u011fi tarihten itibaren 3 (\u00fc\u00e7) g\u00fcn i\u00e7inde ALICI\u2019ya yaz\u0131l\u0131 olarak veya veri saklay\u0131c\u0131s\u0131 ile bildirmesi ve varsa teslimat masraflar\u0131 da d\u00e2hil olmak \u00fczere tahsil edilen t\u00fcm \u00f6demeleri bildirim tarihinden itibaren en ge\u00e7 <b>14 (ond\u00f6rt)<\/b> g\u00fcn i\u00e7inde iade etmesi zorunludur. \u00dcr\u00fcn\u2019\u00fcn stokta bulunmamas\u0131 durumu, \u00dcr\u00fcn ediminin yerine getirilmesinin imk\u00e2ns\u0131zla\u015fmas\u0131 olarak kabul edilmez.<\/li><li>\u0130nternet sitesinde yer alan \u0130ptal ve \u0130ade Ko\u015fullar\u0131 i\u015fbu S\u00f6zle\u015fme\u2019nin ayr\u0131lmaz bir par\u00e7as\u0131d\u0131r. \u0130ade ve cayma h\u00fck\u00fcmleri \u0130ade Ko\u015fullar\u0131 ile birlikte de\u011ferlendirilecek ve talep konusu \u00e7\u00f6z\u00fcmlenecektir.<\/li><\/ol><\/li><\/ol><ol start=\"6\"><li><b>Cayma Hakk\u0131<span class=\"Apple-converted-space\">\u00a0<\/span><\/b><ol><li>ALICI <b>14 (ond\u00f6rt)<\/b> g\u00fcn i\u00e7erisinde ko\u015fulsuz ve \u015farts\u0131z cayma hakk\u0131n\u0131 sahip olup cayma bildirimini i\u015fbu Form\u2019un 3. maddesinde belirtilen kanallar ve\/veya internet sitesi \u00fczerinden y\u00f6neltecektir. ALICI\u2019n\u0131n cayma bildiriminin olumlu sonu\u00e7lanmas\u0131 durumunda kendisine kargo kodu olu\u015fturulur.<span class=\"Apple-converted-space\">\u00a0<\/span><\/li><li>Cayma hakk\u0131 s\u00fcresi, \u00fcr\u00fcn i\u00e7in ALICI\u2019n\u0131n veya ALICI taraf\u0131ndan belirlenen \u00fc\u00e7\u00fcnc\u00fc ki\u015finin \u00fcr\u00fcn\u00fc teslim ald\u0131\u011f\u0131 g\u00fcn ba\u015flar. Ancak ALICI, S\u00f6zle\u015fme\u2019nin kurulmas\u0131ndan \u00fcr\u00fcn teslimine kadar olan s\u00fcre i\u00e7inde de cayma hakk\u0131n\u0131 kullanabilir.<\/li><li>Cayma hakk\u0131 s\u00fcresinin belirlenmesinde; tek sipari\u015f konusu olup ayr\u0131 ayr\u0131 teslim edilen \u00fcr\u00fcnde, ALICI veya ALICI taraf\u0131ndan belirlenen \u00fc\u00e7\u00fcnc\u00fc ki\u015finin son \u00fcr\u00fcn\u00fc teslim ald\u0131\u011f\u0131 g\u00fcn, birden fazla par\u00e7adan olu\u015fan \u00fcr\u00fcnde, ALICI veya ALICI taraf\u0131ndan belirlenen \u00fc\u00e7\u00fcnc\u00fc ki\u015finin son par\u00e7ay\u0131 teslim ald\u0131\u011f\u0131 g\u00fcn, belirli bir s\u00fcre boyunca \u00fcr\u00fcn\u00fcn d\u00fczenli tesliminin yap\u0131ld\u0131\u011f\u0131 durumlarda, ALICI veya ALICI taraf\u0131ndan belirlenen \u00fc\u00e7\u00fcnc\u00fc ki\u015finin ilk \u00fcr\u00fcn\u00fc teslim ald\u0131\u011f\u0131 g\u00fcn esas al\u0131n\u0131r.<\/li><li>SATICI, \u00dcr\u00fcn&#8217;\u00fcn tesliminden \u00f6nce ALICI\u2019n\u0131n cayma hakk\u0131n\u0131 kullanmas\u0131 durumunda cayma hakk\u0131n\u0131n kullan\u0131ld\u0131\u011f\u0131na ili\u015fkin bildirimin kendisine ula\u015ft\u0131\u011f\u0131 tarihten itibaren, \u00dcr\u00fcn\u2019\u00fcn tesliminden sonra Al\u0131c\u0131\u2019n\u0131n cayma hakk\u0131n\u0131 kullanmas\u0131 durumunda, cayma bildiriminin kendisine ula\u015ft\u0131\u011f\u0131 tarih itibar\u0131yla bedel Sat\u0131c\u0131\u2019ya aktar\u0131lmam\u0131\u015fsa cayma hakk\u0131na konu \u00dcr\u00fcn\u2019\u00fcn, iade i\u00e7in \u00f6ng\u00f6r\u00fclen Kargo \u015eirketi\u2019ne teslim edildi\u011fi tarihten veya iade i\u00e7in \u00f6ng\u00f6r\u00fclenin haricinde bir Kargo \u015eirketi ile iade edilmesi durumunda da Sat\u0131c\u0131\u2019ya ula\u015ft\u0131\u011f\u0131 tarihten itibaren,<\/li><\/ol><\/li><\/ol><ol><li>ALICI\u2019n\u0131n sipari\u015finin yasal s\u00fcre i\u00e7erisinde teslim edilememesi nedeniyle S\u00f6zle\u015fme\u2019yi fesih hakk\u0131n\u0131 kullanmas\u0131 durumunda fesih bildiriminin kendisine ula\u015ft\u0131\u011f\u0131 tarihten itibaren <b>14 (ond\u00f6rt)<\/b> g\u00fcn i\u00e7inde, tahsil etti\u011fi S\u00f6zle\u015fme konusu bedeli ile teslimat masraflar\u0131n\u0131n ALICI\u2019ya iadesinden sorumludur.<\/li><\/ol><ol><li style=\"list-style-type: none;\"><ol start=\"5\"><li>Cayma hakk\u0131n\u0131n kullan\u0131lmas\u0131 halinde:<\/li><\/ol><\/li><\/ol><p>a) Al\u0131c\u0131 cayma hakk\u0131n\u0131 kullanmas\u0131ndan itibaren <b>14 (ond\u00f6rt)<\/b> g\u00fcn i\u00e7erisinde \u00dcr\u00fcn\u2019\u00fc Sat\u0131c\u0131&#8217;ya Kargo \u015eirketi\u2019yle geri g\u00f6nderir.<\/p><p>b) Cayma hakk\u0131 kapsam\u0131nda iade edilecek \u00dcr\u00fcn kutusu, ambalaj\u0131, varsa standart aksesuarlar\u0131 ve varsa \u00dcr\u00fcn ile birlikte hediye edilen di\u011fer \u00dcr\u00fcnler\u2019in de eksiksiz ve hasars\u0131z olarak iade edilmesi gerekmektedir.<\/p><ol><li style=\"list-style-type: none;\"><ol start=\"6\"><li>Al\u0131c\u0131 cayma s\u00fcresi i\u00e7inde \u00dcr\u00fcn\u2019\u00fc, i\u015fleyi\u015fine, teknik \u00f6zelliklerine ve kullan\u0131m talimatlar\u0131na uygun bir \u015fekilde kulland\u0131\u011f\u0131 takdirde meydana gelen de\u011fi\u015fiklik ve bozulmalardan sorumlu de\u011fildir.<\/li><li>Cayma hakk\u0131n\u0131n kullan\u0131lmas\u0131n\u0131 takip eden <b>14 (ond\u00f6rt)<\/b> g\u00fcn i\u00e7erisinde S\u00f6zle\u015fme konusu bedeller Al\u0131c\u0131\u2019ya Al\u0131c\u0131\u2019n\u0131n \u00f6deme y\u00f6ntemi ile iade edilmektedir. \u00dcr\u00fcn Sat\u0131c\u0131&#8217;ya iade edilirken, \u00dcr\u00fcn\u2019\u00fcn teslimi s\u0131ras\u0131nda ALICI\u2019ya ibraz edilmi\u015f olan orijinal faturan\u0131n da ALICI taraf\u0131ndan iade edilmesi gerekmektedir. ALICI\u2019n\u0131n kurumsal fatura istemesi halinde ilgili \u00dcr\u00fcn iadesi i\u00e7in iade faturas\u0131 kesmesi veya m\u00fcmk\u00fcnse s\u00fcresi i\u00e7erisinde ticari faturay\u0131 kendi sistemlerinden reddetmesi gerekmektedir.<\/li><li>ALICI, \u00f6n bilgilendirmede kararla\u015ft\u0131r\u0131lmas\u0131 ve Sat\u0131c\u0131\u2019n\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc Kargo \u015eirketi ile iadesinde tutar\u0131na yer verilmesi halinde teslim masraflar\u0131n\u0131 ge\u00e7memek \u00fczere iade masraf\u0131n\u0131 kar\u015f\u0131lamakla y\u00fck\u00fcml\u00fcd\u00fcr. Ancak, ALICI\u2019ya teslim edilen \u00dcr\u00fcn\u2019\u00fcn 6502 say\u0131l\u0131 T\u00fcketicinin Korunmas\u0131 Hakk\u0131nda Kanun\u2019un 8. maddesi kapsam\u0131nda ay\u0131pl\u0131 olmas\u0131 durumunda ALICI iadeye ili\u015fkin masraflardan sorumlu de\u011fildir. ALICI\u2019n\u0131n talep etmesi halinde iade masraf\u0131, kendisine iade edilecek mal veya hizmet bedeli ile teslimat masraflar\u0131ndan mahsup edilebilir. \u0130ade i\u00e7in ALICI\u2019n\u0131n bulundu\u011fu yerde SATICI\u2019n\u0131n Kargo \u015eirketi \u015fubesi bulunmamas\u0131 halinde, ALICI \u00dcr\u00fcn\u2019\u00fc herhangi bir Kargo \u015eirketi\u2019yle g\u00f6nderebilecektir. Bu halde iade kargo bedeli ve \u00dcr\u00fcn\u2019\u00fcn kargo s\u00fcrecinde u\u011frayaca\u011f\u0131 hasardan SATICI sorumludur.<\/li><li>ALICI cayma hakk\u0131n\u0131 i\u015fbu maddede belirtilen s\u00fcre ve usuller dahilinde kullanacak olup aksi halde cayma hakk\u0131n\u0131 kaybedecektir.<\/li><li>ALICI, fiyat\u0131 finansal piyasalardaki dalgalanmalara ba\u011fl\u0131 olarak de\u011fi\u015fen ve sat\u0131c\u0131 veya sa\u011flay\u0131c\u0131n\u0131n kontrol\u00fcnde olmayan \u00fcr\u00fcnlere ili\u015fkin s\u00f6zle\u015fmeler, kendi istekleri veya ki\u015fisel ihtiya\u00e7lar\u0131 do\u011frultusunda haz\u0131rlanan mallara ili\u015fkin s\u00f6zle\u015fmeler ve tesliminden sonra ambalaj, bant, m\u00fch\u00fcr, paket gibi koruyucu unsurlar\u0131 a\u00e7\u0131lm\u0131\u015f olan mallardan; iadesi sa\u011fl\u0131k ve hijyen a\u00e7\u0131s\u0131ndan uygun olmayanlar\u0131n, niteli\u011fi itibariyle geri g\u00f6nderilmeye elveri\u015fli olmayan, kozmetik \u00fcr\u00fcnleri ile g\u0131da maddeleri gibi \u00e7abuk bozulabilen veya son kullanma tarihi ge\u00e7ebilecek \u00fcr\u00fcnler ve tesliminden sonra ba\u015fka \u00fcr\u00fcnlerle kar\u0131\u015fan ve do\u011fas\u0131 gere\u011fi ayr\u0131\u015ft\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcn olmayan \u00fcr\u00fcnlerin<span class=\"Apple-converted-space\">\u00a0 <\/span>teslimine ili\u015fkin s\u00f6zle\u015fmeler kapsam\u0131nda cayma hakk\u0131 kullan\u0131lamayacakt\u0131r.<\/li><li>ALICI, cayma hakk\u0131 bildirimini i\u015fbu Form\u2019un 3. maddesinde belirtilen kanallara ger\u00e7ekle\u015ftirecektir.<span class=\"Apple-converted-space\">\u00a0<\/span><\/li><li>Kart ile al\u0131nm\u0131\u015f mal\u0131n iadesi durumunda SATICI, Banka ile yapm\u0131\u015f oldu\u011fu s\u00f6zle\u015fme gere\u011fi ALICI\u2019ya nakit para ile \u00f6deme yapamaz. SATICI, bir iade i\u015flemi s\u00f6z konusu oldu\u011funda ilgili yaz\u0131l\u0131m arac\u0131l\u0131\u011f\u0131 ile iadesini yapacak olup, SATICI ilgili tutar\u0131 Bankaya nakden veya mahsuben \u00f6demekle y\u00fck\u00fcml\u00fc oldu\u011fundan yukar\u0131da anlatm\u0131\u015f oldu\u011fumuz prosed\u00fcr gere\u011fince ALICI\u2019ya nakit olarak \u00f6deme yap\u0131lamamaktad\u0131r. Kredi kart\u0131na iade, SATICI\u2019n\u0131n Bankaya bedeli tek seferde \u00f6demesinden sonra, Banka taraf\u0131ndan yukar\u0131daki prosed\u00fcr \u00e7er\u00e7evesinde ger\u00e7ekle\u015ftirilecektir. ALICI, bu prosed\u00fcr\u00fc okudu\u011funu ve kabul etti\u011fini taahh\u00fct eder.<\/li><\/ol><\/li><\/ol><p>ALICI al\u0131\u015fveri\u015f esnas\u0131nda sisteme tan\u0131mlad\u0131\u011f\u0131 kredi kart\u0131 bilgilerinin do\u011fru oldu\u011funu, bu kredi kart\u0131n\u0131n kullan\u0131m\u0131ndan dolay\u0131 kaynaklanacak her t\u00fcrl\u00fc hukuki ve cezai yasal sorumlulu\u011funun kendisinde oldu\u011funu kabul ve taahh\u00fct eder. \u00dcr\u00fcn\u00fcn tesliminden sonra ALICI\u2019ya ait kredi kart\u0131n\u0131n ALICI\u2019n\u0131n kusurundan kaynaklanmayan bir \u015fekilde yetkisiz ki\u015filerce haks\u0131z veya hukuka ayk\u0131r\u0131 olarak kullan\u0131lmas\u0131 nedeni ile ilgili banka veya finans kurulu\u015fun \u00fcr\u00fcn bedelini SATICI\u2019ya \u00f6dememesi halinde, ALICI\u2019n\u0131n kendisine teslim edilmi\u015f olmas\u0131 kayd\u0131yla \u00fcr\u00fcn\u00fcn 3 (\u00fc\u00e7) g\u00fcn i\u00e7inde SATICI\u2019ya g\u00f6nderilmesi zorunludur. Bu takdirde nakliye giderleri ALICI\u2019ya aittir. E\u011fer ALICI \u00fcr\u00fcn\u00fc geri g\u00f6ndermezse kredi kart\u0131ndan herhangi bir nedenle \u00fcr\u00fcn bedelinin al\u0131nmamas\u0131 veya \u00fcr\u00fcn bedelinin kredi kart\u0131na iade edilmesi durumlar\u0131nda \u00fcr\u00fcn bedelinin hi\u00e7bir ihtara gerek kalmaks\u0131z\u0131n SATICI banka hesaplar\u0131na havale edilece\u011fini kabul ve taahh\u00fct eder. Al\u0131\u015fveri\u015f yapan\u0131n kart hamili olmas\u0131 ve\/veya kart hamilinin muvafakati ile al\u0131\u015fveri\u015f yapm\u0131\u015f olmas\u0131na ra\u011fmen; kredi kart\u0131n\u0131n yetkisiz kullan\u0131m\u0131 prosed\u00fcr\u00fcn\u00fcn uygulamas\u0131 halinde SATICI\u2019n\u0131n su\u00e7 duyurusunda bulunma ve maddi zarar\u0131n\u0131 talep etme hakk\u0131 vard\u0131r.<\/p><p>Al\u0131\u015fveri\u015f; 3D secure sistemi kullan\u0131larak ger\u00e7ekle\u015ftirilmi\u015f ise, al\u0131\u015fveri\u015f yapan\u0131n kredi kart\u0131n\u0131 yetkili ve yetkisiz olarak kullanm\u0131\u015f olmas\u0131 SATICI a\u00e7\u0131s\u0131ndan \u00f6nem arz etmeyecek ve sat\u0131\u015f i\u015flemi iptal edilemeyecek, kart hamili sat\u0131c\u0131dan herhangi bir \u015fekilde maddi ve\/veya manevi zarar talebinde bulunamayacak olup; sat\u0131c\u0131 al\u0131\u015fveri\u015f s\u00fcrecinde mal\u0131n teslim edilmesi istenilen adres ve ki\u015fi\/kurum\u2019a teslim etmekle kart hamiline kar\u015f\u0131 sorumlulu\u011fundan kurtulacakt\u0131r.<\/p><ol start=\"7\"><li><b>Hizmet Bedeli ve \u00d6deme<\/b><ol><li><b><\/b>ALICI, \u00dcr\u00fcn sipari\u015fi verildi\u011finde, s\u00f6z konusu Hizmet i\u00e7in \u00f6ng\u00f6r\u00fclm\u00fc\u015f olan ve S\u00f6zle\u015fme\u2019de detaylar\u0131na yer verilen Hizmet Bedeli\u2019ni \u00f6deme borcu alt\u0131na girecektir. ALICI\u2019n\u0131n \u00f6demeyi yapmamas\u0131 halinde, sipari\u015f verilmemi\u015f say\u0131lacakt\u0131r.<\/li><li><b><\/b>ALICI, \u00dcr\u00fcn\u2019e ili\u015fkin \u00f6demesi gereken \u00fccretleri \u00f6derken bilgilerini girmi\u015f oldu\u011fu kendisine ve\/veya ba\u015fkas\u0131na ait banka\/kredi kart\u0131n\u0131n ge\u00e7erli bir banka\/kredi kart\u0131 oldu\u011funu, \u00dcr\u00fcn\u2019e ili\u015fkin \u00fccret tutarlar\u0131n\u0131n bu banka\/kredi kart\u0131ndan tahsil edilmesi hususunda kendisinin\/kart sahibinin r\u0131zas\u0131 dahilinde oldu\u011funu kabul ve beyan eder.<\/li><li><b><\/b>\u00d6n Bilgilendirme Formu\u2019nun onaylanarak S\u00f6zle\u015fme\u2019nin akdedilmesinden sonra, herhangi bir nedenle \u00dcr\u00fcn bedeli \u00f6denmez ise veya banka \u00f6demesi iptal edilirse, ALICI\u2019n\u0131n \u00dccret bedelini \u00f6demesi ve SATICI\u2019y\u0131 bilgilendirmesine dek; SATICI \u00dcr\u00fcn\u2019\u00fcn teslimi y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcnden imtina eder.<\/li><li><b><\/b>\u00dcr\u00fcn\u2019e ili\u015fkin \u00f6demenin ALICI taraf\u0131ndan banka\/kredi kart\u0131 ile yap\u0131lmas\u0131 durumunda, ALICI ile banka\/kredi kart\u0131 sahibinin ya da \u00dcr\u00fcn\u2019\u00fcn ifa edilece\u011fi ki\u015finin farkl\u0131 olmas\u0131ndan kaynaklanabilecek olan, banka\/kredi kart\u0131n\u0131n yetkisiz ki\u015filerce haks\u0131z ve hukuka ayk\u0131r\u0131 olarak kullan\u0131lmas\u0131 da dahil olmak \u00fczere t\u00fcrl\u00fc hukuki risk, ALICI\u2019ya aittir.
